Does the Presidential Records Act supersede the Constitution or vice versa?
You still don’t understand this basic legal principle.
Even 305 tried to bring up that Nuclear Whatever Act…. Even that act, which states that certain documents that have nuclear info on them are “born restricted or confidential…”. Even that act would fail at SCOTUS if a president challenged his authority over it.
The President is the closest thing this republic has to a King. Surely the founders took SOME power away in the form of taking the president’s purse away and giving it to the Legislature…
But all of the powers that remained vested in the President via the constitution will always remain with him. No other branch can take it away.
This is what you don’t understand.
The only way this power of classification that the Constitution grants the President, or any enumerated Power, can be taken away from the President would be via Constitutional Convention where the States and Legislature combine their power to amend the constitution.

As I said a couple weeks back… if Trump was taking a shit in a room by himself and just thought to himself, “that document is declassified”…. It’s done. Follow the logic.
The constitution gives the President sole authority over the executive branch. The State Department is who controls the Declass process. The State Department serves the president.
Therefore the President can modify the process anytime or by any method he pleases.
I know it makes it messy and confusing. I get that we demand order and a timeline. I’m with you.
But there is NOTHING in the Constitution, the document that grants the president his power, that calls for any restrictions on the president’s power over his jurisdiction.

I think even the most liberal of justices would agree because once they set restrictions on the President regarding his authority over his own bureaucrats, they open the flood gates for a figure head executive that has no ability to control his government.

Do you understand the full scope of that statement?
That gives the President full, unmitigated power over the Executive Branch of Government.
Ok- so how does it follow DECLASS?
Well, congress (the Legislative Branch) doesn’t DECLASS.
And SCOTUS (the Judiciary Branch) doesn’t DECLASS.
Nope- the State Department is in charge of classification and declassification.
Who is the boss of the State Department?

It’s like the chairman of the board at a private company. Can do whatever he wants in his company.
