It could certainly be challenged - but most hospitals for example require flu shots for employees as a condition of employment.

It kind of isn’t. All it is is a requirement to be vaccinated. How is that looking into you and your medical history?
Again - many employers require the flu vaccine each season. Where’s your outrage there?
Medical surveillance program is defined as
“ **the analysis of health information to look for problems that may be occurring in the workplace that require targeted prevention”
I think Covid vaccines meet this definition.
