It has nno long term legal standing and no funding or authorization by Congress.

DOGE has been given access to Treasury payment systems, USAID data, and other federal records. Via force.

Laws DOGE is Violating (or at Least Bypassing):

  • The Privacy Act of 1974 (5 U.S.C. § 552a)
    • Federal agencies need a legal reason to access personal information (like Social Security, tax data, or employee records).
    • DOGE? It has no legal basis. Just an EO. That’s not enough.
  • The Federal Records Act (44 U.S.C. Chapter 31)
    • Government records belong to the government, not individual agencies.
    • DOGE is not a real agency under federal law. So… what exactly gives it the right to demand access?
  • The Administrative Procedure Act (5 U.S.C. § 551 et seq.)
    • If a federal agency wants to do something big, it’s supposed to go through public notice and transparency processes.
    • DOGE? It skipped that step.

Why is that partisan? Well, first off conservatives don’t believe in either the law nor the Constitution, so its very nature is partisan. Secondly, Elon stated that legally mandated things like Medicaid and USAID are illegal (with no detail or reasoning) and that he personally has the unilateral right to end Congressionally mandated funds to be spent in particular projects/programs as mandated in the Constitution.

Waste, fraud and abuse are the pillars of a Trump presidency. You adore all 3 in reality as long as they are all tinted with dishonesty. That last one appears to be your baseline for all things.

Trump is doing a splendid job in support of taxpayers not footing the bills for leftist give away programs that are not in concert with Trump’s America First program. USAID was created by executive order and can be ended by same, its useful programs transferred to other more responsible agencies such as the Marco Rubio-led Department of State.

What could be more in accord with the Constitution than ending Affirmative Action and its attendant DEI initiatives… Racial discrimination, even when authorized by government, creates victims and flies in the face of neutral criteria for advancement such as merit. That DEI is a compelling government interest does not render it being a constitutional practice, for it violates the 14th Amendment.

Marco Rubio is not, and has never been, the leader of the Department of State. The State Department is an executive branch agency headed by the Secretary of State, appointed by the president and confirmed by the Senate. While Rubio is a U.S. Senator with strong foreign policy views, he does not run the State Department.

  • The 14th Amendment was originally designed to remedy racial discrimination, not to enforce colorblind policies that ignore historical and systemic inequities.

Race consciousness is at the very heart of DEI. I think VDH makes an excellent argument that it constitutes racism, and creates new classes of victims. If Democrats vociferously oppose elimination of DEI, they can appeal to the judiciary, but I think recent Supreme Court decisions indicate that their efforts to justify the practice legally will ultimately fail.

Merit is the most telling factor in evaluating humans’ ability to perform. Under DEI, the NBA would be charged to include more whites and Asians. Hence, sporting ability would be secondary to ethnicity which is patently absurd.
