I’m almost 100% positive that the IRS is constitutional. I agree that supply side tax (income tax) and double taxes are unconstitutional…. But the IRS is simply a Federal agency and I see no reason to call the institution itself unconstitutional. Why do you feel this way? What’s the argument?
The Fed is a tricky one. I think you can argue for its unconstitutionality because the Constitution clearly gives monetary and spending power solely to the legislature. So I guess you can argue that the Fed usurps Congress’s own constitutional authority? I can see that.
But the problem is that Congress themselves created the Fed and believes that so long as they have oversight it should exist. So how would you suppose we get rid of an institution who the litigant who has standing (Congress) will never bring the case to SCOTUS?
