And more specifically, a lot of the suggestions about keeping data and making it available and easy for audits are merely that - SUGGESTIONS. Cyber Ninjas, from what I read in their report (and correct me if I’m wrong), didn’t claim criminal behavior or deletions occurred.
So if you can show me the statute that was violated we can have a discussion, but neither Karen Fann nor Cyber Ninjas said that stuff was a crime.
It’s not the job of auditors to say something is criminal. That is outside of their scope. They aren’t prosecutors nor law enforcement nor judges…
It is the job of auditors to match the data. To review it. Find anomalies. And then report that info. And they did. Enough so to warrant the attorney general to investigate with his Special Elections Unit.
THEY will determine what is criminal and not criminal.
And if I were you, I’d be quiet until Brnovich speaks his peace.
He has power to subpoena anyone he wants and if they don’t comply, they will be in contempt.
I assume he will interview the entire county board of elections, the SOS, and all relevant elections and county officials. And all it takes is one slip up in a deposition or interview to break this whole thing wide open.
I would also assume he can see any data he wants to see…. So the next few weeks should be interesting as it unfolds.
Nah. They did do it for certain stuff if you read the report. For instance, the first item about moving, they outlined why SOME of the counted number MIGHT HAVE broken the law, and they even cited the appropriate code and asked for it to be further investigated.
So nice try, but nope.
Well, don’t overstate this part. Has the AG decided to investigate yet? From what I know, Karen Fann said she was “forwarding the reports for [the AG] office’s consideration and, if [they] find it appropirate, further [investigate].” And also, last I saw the AG was reviewing the info and hasn’t announced an investigation. But I could be behind in the news.
