Pcap does Not imply connection to the internet. You can have a closed network of all the devices connected without an internet connection.
Again, download the software sniff some packets then unplug your router’s cable to the internet. The software will still capture packets traveling on your local network.
Every state has different laws. I don’t know all of them.

It doesn’t imply anything! Imply isn’t the correct term. Pcap doesn’t care where the data is going. Thus the Data/packets could be local network or wide area(upstream to another network potentially upstream to the internet).
No, captured data can be moved physically (think usb devices, hard drives…) . Thus, the network is closed but someone was monitoring it. Getting the pcap captured packets would mean the pcap device was “open”.
Anyone can get data if there is only one device on the network with a connection to another network AND they have access to the root OS of the device.
So I understand what he’s saying. It will also capture device communication data on the same network. But the question still remains. If these machines were on the internet the entire result set should be thrown out. It’s all tainted. It’s the law.

Let me clarify, getting the pcap data doesn’t mean you have access to the physical network. The pcap device can be disconnected from one network then connected to the internet to move the data without compromising the first network.

Prove it was connected! Pcap doesn’t prove it without looking at router logs upstream that would validate the data traversed to/from the internet.

I’ll throw an even bigger wrench at you. It could require multiple layers of routers!
The internet is made up of billions of smaller networks. Each smaller one talks to a router as it is a part of a larger network. Last I checked, there were 7 or 8 US backbone providers with lots of last mile providers. Those last mile providers have many layers of routers that get you to the backbone then to the IP you are trying to reach. IF the IP address is within the network you are on the Data never gets sent to the router. If it goes to a network just above you, it will only have one hop to your router then one hop to the router above the IP you are trying to access. Thus, you can have a very large private network with multiple layers that is completely private.
To fully validate that the network was connected to the internet, you would need to trace the traffic to a network known to have internet access OR the backbone router that shows traffic coming from that network(last mile).
To make matters even more confusing, you can have a private network connected to another private network via a trunk line that isn’t connected to the internet. Think of this trunk as a private backbone thus creating a mini private internet Or wide area network. This is used by lots of industries especially banking.

First, has he proven he really has packet data from those networks? How has it been validated to be from those networks? Mac addresses validated in pcap data to actual machines.
