If he’s acting as the Governor then he is “The State” and has the full authority of his office and the State Constitution behind him.
In some cases a government or a corporation may be recognized as “a person” but it’s impossible to ascribe some required legal elements, which are required to prove a violation here, to a government.
This would be an amazingly uphill legal fight for the most amazing of prosecutors and ultimately would probably not be pursued.

If you mean the jurisdictional argument…. Let’s say someone came to Texas and paid these people or convinced them to leave.
You’d establish jurisdiction but now you’d have to prove that these people are agents of the State of Florida or were directed/paid by them.

No matter what the criminal implications of this are, it definitely looks like DeSantis manufactured a “crisis” in order to misuse Florida funds for a publicity stunt.
